1. Data Controller
The data controller is:
Dare Devices s.r.o.
Registration No.: 07749414
Email: contact@daredevices.com
2. Personal data we process
What we process depends on how you interact with us:
- Waitlist signup — the email address you voluntarily provide via the waitlist form for the Glass Wave product.
- Reservation Code — if you're invited to reserve Glass Wave, the invitation link we send you contains a Reservation Code: an encrypted token derived from your email address. The Code does not itself reveal your email address to anyone without our decryption key, but because it can still be traced back to you — through our records or by decryption — it remains personal data under GDPR.
- Reservation — if you hold a Reservation, we also process the name, email address, billing address, and payment details you provide when paying the Deposit. Payment card details are provided directly to Stripe, our payment processor; we do not receive or store your full card number. Stripe requires the billing address to verify your card, and passes it to us with the rest of your Reservation details.
- Balance collection — once we begin collecting the Balance before shipping (not yet active), we will also ask Reservers for a delivery address. This policy will be updated with the collection details before that starts.
We do not request or process any other personal data.
3. Purpose of processing
We process your personal data for the following purposes:
- Availability notification — alerting waitlist signups when the Glass Wave product becomes available for order
- Waitlist marketing communication — sending waitlist signups news and updates about Glass Wave, including information about development, launch, and further updates after the product goes to market
- Processing your Reservation — holding your place in the queue, sending you a confirmation, and requesting the Balance before shipping
- Marketing about our other products to Reservers — sending Reservers news about Dare Devices products, unless you opted out when reserving
- Payment processing — collecting the Deposit via Stripe, and collecting the Balance later
4. Legal basis for processing
| Purpose | Legal basis |
|---|---|
| Availability notification and marketing to waitlist signups | Your freely given and informed consent, Art. 6(1)(a) GDPR |
| Processing your Reservation (queue place, confirmation, Balance request) | Necessary to perform the reservation agreement with you, Art. 6(1)(b) GDPR |
| Marketing about our other products to Reservers | Our legitimate interest in offering our own products to existing customers, Art. 6(1)(f) GDPR, on the terms of the § 7(3) exemption in Act No. 480/2004 Sb. — you may object at any time, free of charge (see Section 8) |
| Payment processing | Necessary to perform the reservation agreement with you, Art. 6(1)(b) GDPR |
Consent for the waitlist is voluntary. Withholding it has no negative consequences.
5. Data processors
- Ecomail (Ecomail.cz s.r.o., based in the Czech Republic) stores and processes email addresses on our behalf, for both waitlist signups and Reservers. Ecomail is bound by a data processing agreement.
- Stripe processes the Deposit payment on our behalf. Stripe is bound by a data processing agreement.
Your data is not shared with any other third parties.
6. International data transfers
| Provider | Purpose | Data transfer |
|---|---|---|
| Stripe (Stripe, Inc., USA / Stripe Payments Europe, Limited, Ireland) | Payment processing | USA — under the EU-U.S. Data Privacy Framework and standard contractual clauses |
7. Retention period
- Waitlist email address — for the duration of your consent, that is, until it is withdrawn. After withdrawal, your data is permanently deleted.
- Reservation and payment records — for as long as your Reservation stands, and afterwards for 5 years from the end of the accounting period in which the transaction took place, as required by Czech accounting law (Act No. 563/1991 Sb., on Accounting, § 31).
8. Your rights
In accordance with the GDPR, you have the following rights:
- Right of access — the right to obtain confirmation of whether we process your personal data, and if so, to receive a copy
- Right to erasure — the right to request deletion of your personal data, where we are not required by law to keep it
- Right to data portability — the right to receive your personal data in a machine-readable format
- Right to withdraw consent — consent may be withdrawn at any time without negative consequences; withdrawal does not affect the lawfulness of processing carried out prior to withdrawal
- Right to object — where we process your data based on our legitimate interest (marketing about our other products to Reservers), you may object at any time, free of charge and without giving a reason. We will then stop that processing unless we can demonstrate compelling legitimate grounds. Objecting does not affect Reservation-related messages, such as your confirmation or Balance requests, which are not marketing.
To exercise your rights, contact us by email at: contact@daredevices.com
9. Right to lodge a complaint
If you believe that the processing of your personal data violates applicable law, you have the right to lodge a complaint with the Office for Personal Data Protection (ÚOOÚ), Pplk. Sochora 27, 170 00 Prague 7, www.uoou.cz.
